IMPORTANT LEGAL NOTICE

These terms and conditions are the contract between you and Leeds United Football Club Retail (“us”, “we”, etc). By visiting or using Our Website, you agree to be bound by them.

We are Leeds United Football Club Limited, a company registered in England, number 06233875. Our address is Elland Road, Leeds, LS11 0ES.

You are: Anyone who uses Our Website.

Please read this agreement carefully and save it. If you do not agree with it, you should leave Our Website immediately.

  1. 1. DEFINITIONS

    In this agreement:

    Carrier means any person or business contracted by us to carry Goods from us to you.

    Content means any content in any form published on Our Website by us or any third party with our consent.

    Goods means any of the goods we offer for sale on Our Website, or, if the context requires, goods we sell to you.

    Our Website means any website of ours, and includes all web pages controlled by us.

    Post means display, exhibit, publish, distribute, transmit and/or disclose information, Content and/or other material on to Our Website, and the phrases "Posted" and "Posting" shall be interpreted accordingly.

  2. 2. INTERPRETATION

    In this agreement unless the context otherwise requires:

    1. a reference to a person is a reference to one or more individuals, whether or not formally in partnership, or to a corporation, government body, or other association or organisation.
    2. these terms and conditions apply to all supplies of Goods by us to any customer. They prevail over any terms proposed by you.
    3. any agreement by any party not to do or omit to do something includes an obligation not to allow some other person to do or omit to do that same thing.
    4. except where stated otherwise, any obligation of any person arising from this agreement may be performed by any other person.
    5. in this agreement references to a party include references to a person to whom those rights and obligations are transferred or passed as a result of a merger, division, reconstruction or other re-organisation involving that party.
    6. the headings to the paragraphs and schedules (if any) to this agreement do not affect the interpretation.
    7. a reference to an act or regulation includes new law of substantially the same intent as that act or regulation.
    8. these terms and conditions apply in any event to you as a buyer or prospective buyer of our Goods and so far as the context allows, to you as a visitor to Our Website.
    9. this agreement is made only in the English language. If there is any conflict in meaning between the English language version of this agreement and any version or translation of this agreement in any other language, the English language version shall prevail.
  3. 3. OUR CONTRACT WITH YOU
    1. This agreement contains the entire agreement between the parties and supersedes all previous agreements and understandings between the parties.
    2. Each party acknowledges that, in entering into this agreement, he does not rely on any representation, warranty, information or document or other term not forming part of this agreement.
    3. If you use Our Website in any way and make an order on behalf of another person you warrant that you have full authority to do so and you accept personal responsibility for every act or omission by you.
    4. We do not guarantee that Goods advertised on Our Website are available. We may change these terms from time to time. The terms that apply to you are those posted here on Our Website on the day you order Goods.
    5. The price of Goods may be changed by us at any time. We will never change a price so as to affect the price charged to you at the time when you buy those Goods.
    6. If in future, you buy Goods from us under any arrangement which does not involve your payment via Our Website; these terms still apply so far as they can be applied.
  4. 4. ACCEPTANCE OF YOUR ORDER
    1. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the Goods to you.
    2. At any time before the Goods are despatched, we may decline to supply the Goods to you without giving any reason, however, our customer service team will normally contact you to discuss this.
    3. If we do not have all of the Goods you order in stock, we will cancel all or part of your order. A customer service representative will be in touch to discuss this.
  5. 5. PRICE AND PAYMENT
    1. The price payable for the Goods that you order is clearly set out on Our Website.
    2. Prices include any value added tax (“VAT”) applicable in the UK or elsewhere in the European Union.
    3. For customers in the USA and Canada, sales tax will be calculated and added at the checkout once delivery address details are submitted. Customers in the USA and Canada must pay the sales tax.
    4. If the item you order is available in parts, you must pay us the full price of your order before we will send any part of it.
    5. If, by mistake, we have under-priced Goods, we will not be liable to supply that those Goods to you at the stated price, provided that we notify you before we dispatch it to you.
    6. The price of the Goods does not include the delivery charge which will be charged at the rates applicable at the date you place your order and which will be displayed on the delivery page and checkout of Our Website before we ask you to pay.
    7. If we owe you money (for this or any other reason), we will credit your original payment method as soon as reasonably practicable but in any event no later than 14 days from the date when we accept that repayment is due.
  6. 6. GIFT CARDS AND E-GIFT CARDS
    1. Gift cards and e-gift cards are valid for 12 months from purchase. Any remaining balance will be cancelled on the expiry of the validity period.
    2. Any outstanding balance will remain on your Gift Card or e-Gift Card after use, and this amount will appear in your online account.
    3. The value of your Gift Card or e-Gift Card can be spent in the official club stores and at shop.leedsunited.com except for the purchase of any other Gift Card or e-Gift Card.
    4. Gift Cards and e-Gift Cards cannot be redeemed against any ticket or hospitality purchases. Gift Cards and e-Gift Cards are for Leeds United retail only.
    5. Gift Cards and e-Gift Cards are a non-refundable item.
    6. We are unable to replace or reimburse the value of your Gift Card or e-Gift Card if it is lost, stolen or damaged. Please look after your card or e-Gift Card carefully and treat it like cash.
    7. We are unable to give cash change or exchange your Gift Card or e-Gift Card balance for cash.
    8. Funds on the Leeds United Gift Card or e-Gift Card are not covered by the Financial Service Compensation Scheme; in the unlikely event of the issuer of this product becoming insolvent, some funds on your Gift Card may not be available to spend.
    9. It is your responsibility to ensure the gift card number and PIN are typed correctly when using a Gift Card or e-Gift Card at shop.leedsunited.com.
    10. It is your responsibility to ensure your Gift Card or e-Gift Card has been applied successfully before you complete the order.
    11. If a Gift Card or e-Gift Card is unsuccessfully applied to an order, resulting in the full order balance being taken on a credit or debit card, the Gift Card value will not be amended, nor will a refund be issued to the original payment method in order to rectify the user's mistake.
    12. Gift Cards and e-Gift Cards cannot be retroactively applied to an order that has already been placed.
    13. Gift Cards and e-Gift Cards can be used as either full or part payment.
      1. If the value of the items purchased Online is less than the total value of the Gift Card, you can re-enter the same Gift Card details on another occasion to redeem the remaining balance on your Gift Card.
      2. If the value of the items purchased online is more than the total value of the Gift Card, you will need to pay the balance using an alternative payment method.
    14. Every time you use your Gift Card or e-Gift Card, the balance is updated on our secure database. Gift Card balances can be checked at the till in a Club Store or in your account at shop.leedsunited.com.
    15. We reserve the right to take any action we consider appropriate if we have reason to believe you are abusing the Gift Card scheme, including withholding part or all of the balance credited on this card.
    16. Refunds are issued to the original payment method, so please ensure you keep the Gift Card after use, whether it was used as full or partial payment.
    17. Please help protect environmental resources by reusing your Gift Card – by either topping it up for personal use or by passing it on to a friend.
    18. If you would like help using a Leeds United Retail Gift Card, simply ask in store or use the live chat function on our website for more information.
    19. Paper gift vouchers are no longer available to purchase online or in store. If you have a paper gift voucher this can still be redeemed in store only. This voucher CANNOT be redeemed against any online purchase or season ticket sales.
    20. All gift card values are held in GBP.
      1. When using a currency other than GBP to purchase a gift card, the value on the card will be held in GBP.
      2. When checking your gift card value in a currency other than GBP, you may notice fluctuations in the value. This is due to fluctuations in the exchange rate. The GBP value of the gift card remains static.
  7. 7. RETAIL GIFT CARDS AND E-GIFT CARDS ISSUED BY OTHER DEPARTMENTS
    1. On occasion, other departments within Leeds United (e.g., Tickets, Hospitality, etc.) will issue retail Gift Cards and e-Gifts as refunds or gifts
    2. These Gift Cards are subject to a separate set of Terms and Conditions that will be provided by the issuing department.
    3. The Terms and Conditions provided by the issuing department will supersede the stated terms and conditions in this document.
  8. 8. SECURITY OF YOUR CREDIT CARD

    We take care to make Our Website safe for you to use.

    1. Card payments are not processed through pages controlled by us. We use a secure Global-e checkout to offer our customers the ability to checkout in their local currency and access competitive shipping rates.
    2. Global-e offers multiple online payment service providers who will encrypt your card or bank account details in a secure environment.
  9. 9. CANCELLATION AND REFUNDS

    This and the following paragraph apply if you buy as a consumer as defined in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the “Regulations”). Provided the Regulations apply to the transaction concerned, then the following terms apply to the contract.

    1. We now inform you that information relating to all aspects of our Goods is not in this document but in our marketing material, whether that is in the medium of Our Website or in hard copy.
    2. The following rules apply to cancellation of your order:
      1. If you have ordered Goods, you may cancel your order without giving a reason, at any time before the Goods have been picked, packed and despatched. You will have no obligation and we will return your money.
        1. To request the cancellation of your order, please call customer services on 0871 334 2019. Calls cost 10p per minute.
        2. If, when you request cancellation, the order has already been picked and packed, and is awaiting courier collection, it is not possible to cancel the order. The full returns procedure must be followed in order to request a refund.
      2. If you have ordered Goods, and received them, you may return your order for a full refund at any time within 30 days of the date you received them. You must use the returns portal on our website to return your items. You must also send the Goods back to us within that same 30-day period.
    3. We will return your money subject to the following conditions:
      1. we receive the Goods in a condition in which we can re-sell them at full price, in new condition, with labels and packaging intact.
      2. you comply with our procedure for returns and refunds. We cannot return your money unless we know who returned the items.
    4. The option to return your order for a refund is not available:
      1. if you purchase sealed goods which relate to health or hygiene, and they become unsealed after delivery, or cannot be re-sold for some other reason;
      2. if they are a hard medium for a product in soft copy (e.g., DVD, Blu-ray, etc.), which comes to you sealed and is returned to us unsealed.
      3. if the Goods are somehow mixed with other goods so that we cannot identify or easily separate them.
      4. if the Goods have been personalised, including, but not limited to, a personalised shirt or a player’s named and numbered shirt, even in the case that the player leaves the club or their squad number changes during the season.
      5. If the Goods being returned is a Gift Card.
    5. You are responsible for the cost of returning the Goods. We have no obligation to refund to you your cost of re-packing and returning the Goods.
    6. When using our returns portal, there are two postage options to choose from:
      1. Pre-paid express postage – our carrier will deliver your return parcel back to us. The cost of the return delivery will be deducted from your refund and will be displayed clearly within the returns portal.
      2. Self-postage - pay for and use your preferred postal service.
    7. Leeds United is not responsible for any self-postage parcels that are subsequently lost in transit.
    8. For combination, multi-buy or any other promotional purchases, any free items or vouchers must be returned to us before we can process a refund.
    9. In any of the above scenarios, we will return your money within 14 days from receipt of the returned goods.
    10. It is not possible to exchange items. If you require a different size or product, please return your items for a full refund and place a new order through the official website.
  10. 10. LIABILITY FOR SUBSEQUENT DEFECTS
    1. Please examine the Goods received from us immediately when you receive them. If you do not tell us of any defect or problem within 30 days of receipt of the Goods, we shall assume that you have accepted them.
    2. The procedure to return the faulty Goods is as follows:
      1. the Goods must be returned to us as soon as any defect is discovered but not later than six months from receipt by you.
      2. before you return the Goods to us, please carefully re-read the instructions and check that you have assembled it correctly, complied with any provisions relating to the power supply, plugs and sockets, etc.
      3. please follow the returns procedure provided on our website and set out on the reverse side of the delivery note.
    3. We will return your money subject to the following conditions:
      1. you comply with our returns procedure. We cannot return your money unless we know who sent them.
      2. you tell us clearly what is the fault you complain of, when it first became apparent, and other information to enable us to identify or reproduce it.
    4. If any defect is found, then we shall:
      1. repair or replace the Goods, or
      2. refund the full cost you have paid including the cost of returning the Goods.
  11. 11. DESPATCH AND DELIVERY
    1. We aim to despatch all orders within 3-5 working days from the day you place an order. For personalised orders, please allow up to 10 working days.
    2. Deliveries will be made by the Carrier to the address stipulated in your order. You must ensure that someone is present to accept the delivery.
    3. Once Goods are in transit, the Carrier is responsible for any lost, misplaced, or stolen packages.
    4. You will be provided with a tracking number for your parcel once it has been despatched. If you have any issues with your parcel while it is in transit, please contact the Carrier.
    5. If the goods are not available at the same time for delivery, we may:
      1. deliver the Goods in instalments;
      2. or hold the Goods until they are all available for despatch.
    6. Goods must be signed for on delivery by an adult aged 18 years or over. If no one of that age is at the address when the delivery is attempted the Goods may be retained by the driver. When your Goods arrive, it is important that you check immediately the condition and quantity.
    7. If the Goods are age-restricted (e.g., alcohol, etc.), you must present a valid photo ID to prove your age to the Carrier on delivery.
    8. If the Goods have been damaged in transit, you must refuse the delivery and immediately contact us, so the order can be cancelled and a new order can be placed.
    9. Signing "Unchecked", "Not Checked" or similar is not acceptable.
    10. Goods are sent by post. We will send you a message by email to tell you when we have despatched your order.
    11. If we agree with you to deliver on a particular day or at a particular time, we will do our best to comply. But no time given is to be treated as contractual. So we are not liable to you for any expense or inconvenience you incur on account of delayed delivery or non-delivery.
    12. Some Goods may be delivered direct from the manufacturer who will contact you to arrange delivery. When delivery of the Goods has been arranged directly with the manufacturer, you will be subject to the manufacturer's delivery policy.
    13. Some Goods are so large and heavy that delivery times may be slightly longer.
    14. Time for delivery specified on the order, if any, is an estimate only and time shall not be of the essence.
  12. 12. FOREIGN TAXES AND DUTIES
    1. For orders placed with a delivery address in select countries, tax and duties will be settled by us on your behalf with our courier.
    2. We will settle all taxes and duties on behalf of the customer for orders dispatched to:
      1. All EU countries, plus Switzerland and Norway;
      2. Australia and New Zealand;
      3. USA and Canada.
    3. For orders with a delivery address anywhere else except the UK and those countries listed above, we may offer a guaranteed landed cost shipping service which allows you the option to prepay all taxes at checkout.
    4. You are responsible for purchasing Goods which you are lawfully able to import.
    5. Full details on taxes and duties are available in the checkout once a delivery address has been submitted.
  13. 13. PERSONALISED ITEMS AND SHIRT PRINTING
    1. Personalised items, including, but not limited to, a personalised shirt or a player’s named and numbered shirt cannot be returned for either a refund or exchange.
    2. The above statement applies even if the player subsequently leaves the club or his squad number changes during the season.
    3. You are responsible for ensuring all details are correct before submitting your order. This includes but is not limited to:
      1. Ensuring the correct spelling and number is supplied.
      2. Selecting the correct size.
    4. We reserve the right to refuse the printing of shirts and personalisation of other items that we deem to be, or could be interpreted as, offensive or abusive and/or may infringe our intellectual property rights of companies and/or individuals.
    5. In the event we refuse to print a shirt or personalise a product, a Customer Care operative will contact you to discuss your choice and, if necessary, request an alternative. Please note this may delay delivery of your shirt. The decision of Leeds United is final.
    6. We cannot guarantee that the sizing for current replica kits is the same as previous replica kits.
    7. You are responsible for ensuring you obtain the correct size before printing, as we are unable to exchange or refund after your item has been personalised.
    8. If you choose to have your shirt printed by a third party, we will not be liable for any faults.
    9. Personalised shirts occasionally appear creased on arrival. This is due to the shirt being packaged for transit. It can easily be resolved by following the instructions below:
      1. Place a clean, damp cloth over the personalisation and press with a warm iron.
      2. Do not iron directly onto the personalisation.
      3. Follow the washing instructions on the garment care label and do not tumble dry your shirt once it has been personalised.
    10. We advise to avoid the use of fabric softener when washing printed garments, as this may result in the personalisation peeling off.
    11. Over time, the printing on the garment may become faded, cracked, or start to detach, etc. We consider this to be normal wear and tear and no refund will be issued.
    12. We offer a complimentary re-pressing service in stores for existing personalisation on shirts and shorts. If the printing on your garment starts to peel away, please visit one of our stores to request this service.
    13. If we cannot re-press the original personalisation, you will be charged to re-personalise the garment.
  14. 14. WASTE ELECTRONIC AND ELECTRICAL EQUIPMENT REGULATIONS 2013
    1. These regulations provide that suppliers of equipment like high street shops and Internet retailers must allow Consumers to return their waste equipment free of charge.
    2. Our obligation is to take back from you any electronic or electrical product when you buy a replacement product for similar use.
    3. If you wish to take advantage of this service, you must return your waste item within 28 days of buying your new one. You must pay the carriage cost to us.
  15. 15. DISCLAIMERS
    1. The law differs from one country to another. This paragraph applies so far as the applicable law allows.
    2. All implied conditions, warranties and terms are excluded from this agreement. If in any jurisdiction an implied condition, warrant or term cannot be excluded, then this sub paragraph shall be deemed to be reduced in effect, only to the extent necessary to release that specific condition, warranty or term.
    3. We make no representation or warranty for:
      1. any implied warranty or condition as to merchantability or fitness of the Goods for a particular purpose;
      2. the adequacy or appropriateness of the Goods for your purpose.
    4. We claim no expert knowledge in any subject. We disclaim any obligation or liability to you arising directly or indirectly from information you take from Our Website.
    5. You agree that in any circumstances when we may become liable to you, the limit of our liability is the amount you have paid us in the immediately preceding 12-month period for the Goods concerned.
    6. We shall not be liable to you for any loss or expense which is:
      1. indirect or consequential loss; or
      2. economic loss or other loss of turnover, profits, business or goodwill, even if such loss was reasonably foreseeable or we knew you might incur it.
    7. If you become aware of any breach of any term of this agreement by any person, please tell us via our contact page. We welcome your input but do not guarantee to agree with your judgement.
    8. Nothing in this agreement excludes liability for a party's fraud.
  16. 16. YOUR ACCOUNT WITH US
    1. You agree that you have provided, and will continue to provide accurate, up to date, and complete information about yourself. We need this information to provide you with the Goods.
    2. If you use Our Website, you are responsible for maintaining the confidentiality of your account and password and for preventing any unauthorised person from using your account.
    3. You agree to accept responsibility for all activities that occur under your account or password. You should tell us immediately if you believe some person has accessed your account without your authority, and also log in to your account and change your password.
  17. 17. REMOVAL OF OFFENSIVE CONTENT
    1. For the avoidance of doubt, this paragraph is addressed to any person who comes on Our Website for any purpose.
    2. If you are offended by any Content, the following procedure applies:
      1. Your claim or complaint must be submitted to the official complaints department via email to slocomplaints@leedsunited.com.
      2. we shall remove the offending Content as soon as we are reasonably able;
      3. after we receive notice of a claim or complaint, we shall investigate so far as we alone decide;
    3. We may re-instate the Content about which you have complained or not.
  18. 18. SECURITY OF OUR WEBSITE

    If you violate Our Website we shall take legal action against you. You now agree that you will not, and will not allow any other person to:

    1. modify, copy, or cause damage or unintended effect to any portion of Our Website, or any software used within it.
    2. link to Our Website in any way that would cause the appearance or presentation of the site to be different from what would be seen by a user who accessed the site by typing the URL into a standard browser;
    3. download any part of Our Website, without our express written consent;
    4. collect or use any product listings, photographs, descriptions, or prices;
    5. collect or use any information obtained from or about Our Website or the Content except as intended by this agreement;
    6. aggregate, copy or duplicate in any manner any of the Content or information available from Our Website, other than as permitted by this agreement or as is reasonably necessary for your use of Our Website;
    7. share with a third party any login credentials to Our Website.
    8. Despite the above terms, we now grant a licence to you to:
      1. create a hyperlink to Our Website for the purpose of promoting an interest common to both of us. You can do this without specific permission. This licence is conditional upon your not portraying us or any product or service in a false, misleading, derogatory, or otherwise offensive manner. You may not use any logo or other proprietary graphic or trademark of ours as part of the link without our express written consent.
      2. you may copy the text of any page for your personal use in connection with the purpose of Our Website.
  19. 19. INDEMNITY

    You agree to indemnify us against all costs, claims and expense arising directly or indirectly from:

    1. your failure to comply with the law of any country;
    2. your breach of this agreement;
    3. any act, neglect or default by any agent, employee, licensee or customer of yours;
    4. contractual claim arising from your use of the Goods;
    5. a breach of the intellectual property rights of any person.
  20. 20. INTELLECTUAL PROPERTY
    1. We will defend the intellectual property rights in connection with our Goods and Our Website, including copyright in the Content whether provided by us or by any other content provider (including copyright in: text, graphics, logos, icons, images, audio clips, digital downloads, data, and software).
    2. Except as set out below, you may not copy, modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the Content, in whole or in part.
    3. You may not use our name or logos or trademarks or any other Content on any website of yours or that of any other person.
    4. Subject to the other terms of this agreement, you may download or copy Content only for your own personal use, provided that you maintain all copyright and other notices contained in it. You may not store electronically any significant portion of any Content.
  21. 21. DISPUTE RESOLUTION

    The following terms apply in the event of a dispute between the parties:

    1. If you are not happy with our services or have any complaint, then you must tell us via the contact page on Our Website or by email message to shop@leedsunited.com.
    2. If a dispute is not settled as set out above, we hope you will agree to attempt to resolve it by engaging in good faith with us in a process of mediation or arbitration.

These Terms and Conditions are based on a set written by Net Lawman and released under licence. They protect your rights as well as ours.
